OVERVIEW
CFAITH Communities is an extension of the cooperative ministry outreach and inreach efforts of
CFAITH (www.cfaith.com). CFAITH Communities
is a faith-based networking service that allows Members to signup and create a
personalized profile and blog in order to communicate with other Christians
around the world. Those who join or visit the CFAITH Communities website can
share & discuss their faith while interacting with other believers in a
safe, secure, and friendly online environment.
As a faith-based website, CFAITH Communities endeavors to provide its members
and guests with a positive interactive experience. Therefore, the following
Terms of Use Agreement ("Agreement") establishes the legally binding terms for
your use of the CFAITH Communities website. Through your active participation in
the CFAITH Communities website (“Website” or “Site”), you agree to be bound by
this agreement. This agreement applies to both “Members” (one who has registered
with CFAITH Communities) and “Visitors” (one who simply visits or browses the
CFAITH Communities website). A "User" of this website refers to either a Visitor
or a Member.
In addition, when using or visiting CFAITH Communities, you shall be subject
to our Privacy Policy as well as all other posted rules, guidelines,
standards, and notices applicable to this site/service. You are only authorized
to use the CFAITH Communities website if you agree to abide by all applicable
laws to this Agreement. If you do not agree to, or cannot comply with, all terms
and conditions of this Agreement, you should leave and discontinue the use of
the CFAITH Communities website.
CFAITH Communities may (without prior notice) change, update, or modify the
terms and conditions of this Agreement. Such modifications shall be effective
when the amended Agreement is posted on the CFAITH Communities website. We
encourage all Users to review this Agreement and become familiar with its terms
and conditions. It is the User’s responsibility to regularly review this
Agreement in order to become aware and/or familiar with any/all updates,
changes, or modifications. If you continue to visit and utilize the services of
the CFAITH Communities website after any amendments have been posted, you will
be deemed to have accepted the Agreement as amended.
We expect all Users to communicate, respond, post, and interact with other
Users in a Christ-like manner. CFAITH Communities Members and Visitors should
use caution regarding the information they post or display on this Site and in
their personal profile. Users should NOT include their telephone number, street
address, last name, email address, or URL in their member or blog profile. Under
no circumstances will photographs containing nudity, or obscene, sexually
explicit, harassing, lewd, violent, or otherwise objectionable subject matter be
allowed or tolerated. CFAITH Communities reserves the right (but not the
obligation) to reject, refuse to post, or remove any (public or private) posting
by you, or to restrict, suspend, delete, or terminate your access to any or all
parts of the Site at any time, for any reason, with or without prior notice, and
without liability.
As a ministry based organization, CFAITH will not tolerate any posts, statements, reports, questions, or assertions which introduces or causes direct, indirect, or perceived damage, harm, or offense toward any individual, company, ministry organization, church, or affiliate ministry partner of CFAITH.com. Any and all communication of this nature that is directed toward a specific person or ministry entity will be immediately blocked, suspended, or removed from the CFAITH Communities website.
If you discover abuse or misuse of this Site by another Member or Visitor,
please inform us immediately by clicking on the Report Abuse link located
in the Member Tools section located at the top of the CFAITH Communities home
page. Awareness and cooperation with the terms and conditions of this agreement
will help ensure CFAITH Communities can continue to provide its Members with an
exciting and powerful interactive experience within a safe, clean, and secure
online environment.
TERM
This Agreement shall remain in full force and effect while you
use the Service and/or are a Member. In the event that membership is terminated,
all provisions of this Agreement which must survive in order to give effect to
their meaning, including without limitation all of your representations,
warranties, and indemnification obligations, shall survive. By using the Service
and/or becoming a Member, you acknowledge that CFAITH Communities has the right
to terminate your membership should you violate this Agreement.
PARENTAL ADVISORY
If you are between 13 and 17 years of age, please review this agreement with
your parents or guardians. You must be at least 13 years old to use or
participate in the CFAITH Communities website. Parental discretion is advised
for all users aged 13-17. This agreement includes warranty and liability
disclaimers. By using the service, you accept and agree to all terms and
conditions of this agreement without modification, addition, or deletion. If you
do not or cannot agree to all of the terms and conditions, you may not use the
service. In the event of any noncompliance with this agreement, CFAITH
Communities may deny access to the service at any time, with our without prior
notice and without liability.
ELIGIBILITY
You represent and warrant that you are at least 13 years old. If you
misrepresent your age, we may terminate your CFAITH Communities account at any
time without warning, and without liability. You are solely responsible for
maintaining the security and confidentiality of your password and other Member
account information. You agree not to permit others to use your password or
other Member account information, and you agree to notify CFAITH Communities
immediately of any unauthorized use of that information. CFAITH Communities will
not be responsible for any loss or damage arising out of the unauthorized use of
your password or other Member account information; and you agree to indemnify
and hold harmless CFAITH Communities, its officers, directors, agents,
employees, subsidiaries, and affiliates for any unauthorized, improper, or
illegal use of that information. You, and not CFAITH Communities, are solely
responsible for all Content published or displayed through your account,
including without limitation any posts, forum comments, blogs, photos, email
messages, or tags, and for your interactions with other Members or users. You
further represent and warrant that your use of the Service will not violate any
applicable law or regulation.
CONTENT
A. The Service enables you to upload, archive, post, publish, or otherwise
transmit to CFAITH Communities ("Upload") text, messages, tags, and other
information, data, or material ("Content"). You, and not CFAITH Communities, are
solely responsible for all Content that you Upload to the CFAITH Communities
public archives, blogs, forums, photos, search results, categories, groups, or
any other part of the Site. No text from this Site may be used for any purpose
without expressed written authorization, with one exception; you may post text
as a link to this site.
B. By way of example, and not as a limitation, you agree not to do the
following in conjunction with CFAITH Communities:
1) Contribute any Content that violates any law
2) Use the website and its contents for any illegal or unauthorized purpose.
If you are an international user, you agree to comply with all local laws
regarding online conduct and acceptable content
3) To post any comments, information, or text in a personal or public blog or
forum that is obscene, sexually explicit, harassing, lewd, violent,
antagonistic, or otherwise objectionable in nature
4) To post or transmit, or cause to be posted or transmitted, any
communication or solicitation designed or intended to obtain password, account,
or private information from any CFAITH Communities Member or Visitor
5) Create or submit unwanted email ("Spam") to any other CFAITH Communities
users or any URL
6) Violate any laws in your jurisdiction (including but not limited to
copyright laws)
7) With the exception of accessing RSS feeds, you will not use any robot,
spider, scraper or other automated means to access the Site for any purpose
without our express written permission. Additionally, you agree that you will
not: (i) take any action that imposes, or may impose in our sole discretion an
unreasonable or disproportionately large load on our infrastructure; (ii)
interfere or attempt to interfere with the proper working of the Site or any
activities conducted on the Site; or (iii) bypass any measures we may use to
prevent or restrict access to the Site
8) Create separate user accounts with the intention of artificially inflating
the CFAITH Communities count, blog count, forums, comments, or any other CFAITH
Communities service.
C. In connection with Content that you upload to CFAITH Communities, you
represent and warrant that: (1) you own, or have the necessary licenses,
consents, permissions, and rights to use and to authorize CFAITH Communities to
use, all copyright, trademark, patent, trade secret, and other proprietary
rights in and to all such Content, in order to permit inclusion and use of the
Content as contemplated by the Service and this Agreement; and (2) you have the
written consent, release, and/or permission of every person identifiable in the
Content to use their name and likeness, in order to permit inclusion and use of
the Content as contemplated by the Service and this Agreement.
D. You retain all of your ownership rights in Content that you upload to
CFAITH Communities. However, by uploading the Content to CFAITH Communities, you
hereby grant to CFAITH Communities a worldwide, non-exclusive, royalty-free,
fully paid-up, perpetual, irrevocable, fully sub-licensable (through multiple
tiers), and transferable license to copy, distribute, prepare derivative works
of, adapt, publicly perform, publicly display, and use the content in connection
with the Service and CFAITH Communities business, including without limitation
promotion and redistribution of the service and derivative works thereof,
through any media channel and in any media format known now or in the future. In
addition, you hereby grant to each CFAITH Communities User a non-exclusive
license to access the uploaded content through the service, and to reproduce,
distribute, prepare derivative works of, adapt, publicly perform, publicly
display, and use such content as permitted through the service functionality and
under this Agreement. All tags and comments associated with Content—whether
associated by you, the Service, other Members or users, or anyone else—become
CFAITH Communities property; but CFAITH Communities will grant you a perpetual
right to use such tags and comments for personal, noncommercial purposes.
E. Although all Users of CFAITH Communities are strongly encouraged to act
and communicate in a Christ-like manner while using the Services of this
Website, it is still possible to access and be exposed to content uploaded by
others that is inaccurate, incomplete, indecent, offensive, or otherwise
objectionable. Uploaded or posted content is the sole responsibility of the
person who uploaded and/or posted it. You will not hold CFAITH Communities
responsible for the actions or inactions of Members or Visitors, including
without limitation any uploaded content. CFAITH Communities does not make any
representation or warranty about the accuracy, integrity, quality, or any other
aspect of content posted on the Site or in connection with the service. CFAITH
Communities expressly disclaims all liability for any loss or damage incurred as
a result of the use of such content. By using the service, you agree to bear all
risks associated with any use of any content posted on the Site or in connection
with the service and any reliance on the accuracy, completeness, or usefulness
of such content. Any opinions, statements, advice, offers, services, or other
information or material expressed or made available in or through uploaded
content are those of the respective author(s) of such content and not of CFAITH
Communities.
F. CFAITH Communities maintains the right—but is not obligated—to pre-screen,
edit, or review content or photographs uploaded to CFAITH Communities archives
or publicly available areas of the service. If CFAITH Communities is notified by
a Member, Visitor, or content owner of content posted on the Site or in
connection with the service that allegedly does not conform to our persuasion of
faith or to this Agreement, CFAITH Communities may investigate the allegation
and determine in good faith, in CFAITH Communities’ sole discretion, whether to
remove or block access to such content.
G. You acknowledge and agree that CFAITH Communities may access, preserve,
and disclose your account information and content if required by law or in a
good faith belief that it is reasonably necessary in order to: (1) comply with
legal process; (2) enforce the Agreement; (3) respond to claims that any content
violates the rights of Members, Users, or third-parties; (4) respond to your
requests for customer service; or (5) protect the rights, property, or personal
safety of CFAITH Communities, its Members or Users, and the public.
H. In no event shall CFAITH Communities be liable for any special,
incidental, or consequential damages that are directly or indirectly related to
the use of or the inability to use the site or the content, materials, and
functions related there to even if CFAITH Communities or an authorized
representative thereof has been advised of the possibility of such damages. Some
jurisdictions do not allow the limitation or exclusion of liability for
incidental or consequential damages so some of the above limitations may not
apply to certain users. In no event shall CFAITH Communities be liable to you
for any damages, losses and causes of action (whether in contract or tort,
including, but not limited to negligence or otherwise) arising from this
agreement or your use of the site.
I. CFAITH Communities may delete any Content that in the sole judgment of
CFAITH Communities violates this Agreement or which may be offensive, harmful, illegal, threatening, or
which may violate the rights or safety of any person or organization. CFAITH
Communities assumes no responsibility for monitoring the Site’s Services for
inappropriate Content or conduct. If at any time CFAITH Communities chooses, in
its sole discretion, to monitor the CFAITH Communities Services, CFAITH
Communities nonetheless assumes no responsibility for the Content, no obligation
to modify or remove any inappropriate Content, and no responsibility for the
conduct of the User submitting any such Content.
J. You are solely responsible for the Content that you post on or through any
of the CFAITH Communities Services, and any material or information that you
transmit to other Members and for your interactions with other Users. CFAITH
Communities does not endorse and has no control over the Content. Content is not
necessarily reviewed by CFAITH Communities prior to posting and does not
necessarily reflect the opinions or policies of CFAITH Communities. CFAITH
Communities makes no warranties, express or implied, as to the Content or to the
accuracy and reliability of the Content or any material or information that you
transmit to other Members.
COPYRIGHT POLICY
You may not post, modify, distribute, or reproduce in any way any copyrighted
material, trademarks, or other proprietary information belonging to others
without obtaining the prior written consent of the owner of such proprietary
rights. It is the policy of CFAITH Communities to terminate Membership
privileges of any Member who repeatedly infringes the copyright rights of others
upon receipt of proper notification to CFAITH Communities by the copyright owner
or the copyright owner's legal agent. Without limiting the foregoing, if you
believe that your work has been copied and posted on the CFAITH Communities
services in a way that constitutes copyright infringement, please provide our
Content Director with the following information: (i) an electronic or physical
signature of the person authorized to act on behalf of the owner of the
copyright interest; (ii) a description of the copyrighted work that you claim
has been infringed; (iii) a description of where the material that you claim is
infringing is located on the CFAITH Communities services; (iv) your address,
telephone number, and email address; (v) a written statement by you that you
have a good faith belief that the disputed use is not authorized by the
copyright owner, its agent, or the law; (vi) a statement by you, made under
penalty of perjury, that the above information in your notice is accurate and
that you are the copyright owner or authorized to act on the copyright owner's
behalf. CFAITH Communities’ Content Director for notice of claims of copyright

NON-COMMERCIAL USE ONLY
CFAITH Communities is for the personal use of individual Members and Visitors
only and may not be used in connection with any commercial event or ministry endeavor, except
those that are specifically approved or endorsed in writing by CFAITH
Communities management. Organizations, companies, and/or businesses may not
become Members and should not use the Service for any commercial or retail
purpose. Likewise, Members and Visitors cannot use this service to market,
promote, and/or sell products or services to other Members or Visitors.
Passwords, Member or User names, links, and any other content may not be
transferred or copied from the service for use with any other product or
service. Any use of the service that is illegal, unlawful, or that violates the
letter or spirit of this Agreement or any other posted CFAITH Communities
policies, guidelines, or notices, including without limitation collecting Member
or User names and/or email addresses by electronic or other means for the
purpose of sending unsolicited emails or unauthorized linking to the Site, may
be investigated and may result in CFAITH Communities suspending or terminating
your account, refusing any and all current or future use of the service (or any
portion thereof), and taking appropriate legal action, including without
limitation criminal, civil, and injunctive redress. CFAITH Communities reserves
all right, title, and interest in the Service not expressly granted under this
Agreement to the fullest extent possible; and any use of the Service not
specifically permitted under this Agreement is prohibited.
CONDUCT AND BEHAVIOR
You agree that you will not, and it shall be a violation of this Agreement
to:
A. Upload, copy, distribute, share, sell, create derivative works of, or
otherwise alter or use any Content, in whole or in part, for any purpose
whatsoever except as expressly authorized in this Agreement; and to do so in any
manner exceeding the scope of your rights to use such Content (e.g., license
rights associated with premium content or subscription-based materials), without
permission from the Content owner, or otherwise in violation of another person's
rights to such Content.
B. Upload, copy, distribute, share, or otherwise use Content that is
unlawful, defamatory, libelous, harmful, offensive or hateful on the basis
harassing, that would violate another person's rights, constitute or encourage a
criminal offense, give rise to civil liability, or violate any local, state,
national, or international law or regulation, or that is otherwise
inappropriate.
C. Upload, copy, distribute, share, or otherwise use Content that constitutes
advertising or promotional material, if posted in areas of CFAITH Communities
which are not designated for such purposes (e.g., not in the classified ads), or
if "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of
unsolicited or unauthorized commercial communication. To protect our Members
from such advertising or solicitation, CFAITH Communities reserves the right to
(among other things) restrict the number of posts, forum threads, or emails that
a Member may send to other Members in any 24-hour period, to a number that
CFAITH Communities deems appropriate in its sole discretion.
D. Upload, copy, distribute, share, or otherwise use Content that contains or
embodies software viruses, worms, Trojan horses, bugs, or any other harmful
computer code that is designed to interrupt, undermine, destroy, or limit the
functionality of any computer software, hardware, or telecommunications
equipment, or that is designed to perform functions on any software, hardware,
or equipment without the owner's express consent.
E. Upload, copy, distribute, share, or otherwise use Content that is false,
deceptive, misleading, deceitful, or constitutes "bait and switch."
F. Upload, copy, distribute, share, or otherwise use Content that advertises
any illegal service or the sale of any items the sale of which is prohibited or
restricted by any applicable law.
G. Include in your Member profile any telephone number, street address, last
name, URL, or email address.
H. Disclose your password or transfer your account to any third party, or
allow any third party to access your account.
I. Impersonate any person or entity, including without limitation CFAITH
Communities officials, staff, and/or Members.
J. Upload, copy, distribute, share, or otherwise use Content that includes
personal or identifying information about another person without that person's
explicit consent.
K. Access the Service by any means other than through the interface provided
by CFAITH Communities for use in accessing the Service. This includes not using
or launching any automated system that accesses the Service in a way that sends
more request messages to the CFAITH Communities servers in a given time period
than a human reasonably can produce in the same time period using a conventional
online Web browser. Notwithstanding this, CFAITH Communities grants the
operators of general purpose Internet search engines permission to use spiders
to copy Content from the Site for the sole purpose of creating publicly
available, searchable indices of such Content, but not caches or archives of
such Content. ("General purpose Internet search engine" does not include a
website or search engine or other service that specializes in classified
listings or in any subset thereof, such as jobs, housing, for sale, services, or
personals, or that is in the business of providing classified ad listing
services.) CFAITH Communities reserves the right to revoke these exceptions, in
general or specific instances.
L. Interfere with or disrupt the Service or servers or networks connected to
the Service, make the Service available over a network (other than CFAITH
Communities's network) where it could be used by others, or disobey any
requirements, procedures, policies, or regulations of networks connected to the
Service.
M. Use the Service to artificially generate traffic or page links to a
website or for any other purpose not intended for personal, noncommercial use of
the Service.
N. Use the Service as a fundraising tool. Members are prohibited from using the site to solicit donations or to generate contributions from other members or visitors for any reason.
O. Collect, harvest, or store any personally identifiable information,
including Member account information, from the Service.
P. Translate, reverse engineer, decompile, disassemble, modify, or create
derivative works based on the Service, in whole or in part.
Q. Circumvent, disable, violate, or otherwise interfere with any security
related feature of the Service, or any technology or feature that restricts or
prevents copying or use of Content or that enforces limitations on use of the
Service or Content.
R. Rent, lease, sublicense, transfer, sell, trade, resell, or exploit for any
commercial purposes, any portion of the Service (including without limitation
your account information), use of the Service, or access to the Service.
S. Use the Service to harass or "stalk" anyone.
T. Upload Content that exploits anyone under the age of 18 in a sexual or
violent manner, or that solicits personally identifiable information from anyone
under the age of 18.
U. Use the Service in any way to provide material support or resources (or to
conceal or disguise the source, location, nature, or ownership of material
support or resources) to any organization designated by the U.S. government as a
foreign terrorist organization under section 219 of the Immigration and
Nationality Act, 8 U.S.C. P 1189.
V. Use the Service in any way that violates the terms of this Agreement, or
that aids, encourages, or purports to authorize anyone else to violate the terms
of this Agreement.
W. Use the Service in any way that intentionally or unintentionally violates
any applicable local, state, national, or international law or regulation.
X. Abuse tagging rights. CFAITH Communities closely monitors tags made in
error, and tag abuse may result in the suspension of your account.
PRIVACY
As explained herein, use of the Site and Service is also governed by our
Privacy Policy.
MEMBER DISPUTES
You are solely responsible for your interaction with other CFAITH Communities
Members or Users, whether online or offline. CFAITH Communities reserves the
right, but has no obligation, to monitor or become involved in disputes between
you and other Members or users. If you have a dispute with one or more Members
or users, you release CFAITH Communities (and our officers, directors, agents,
employees, subsidiaries, and affiliates) from claims, demands, and damages
(actual and consequential) of every kind and nature, known and unknown, arising
out of or in any way connected with such dispute.
LIMITATION ON LIABILITY
In no event shall CFAITH Communities be liable to you or any third person for
any indirect, general, special, consequential, incidental, exemplary, punitive,
or other damages, including without limitation damages for loss of revenue or
income, business interruption, corruption of data, personal injury, death, pain
and suffering, emotional distress, or any other tangible or intangible loss
arising from your use of the Site or Service, even if CFAITH Communities has
been advised of the possibility of such damages. No advice or information,
whether oral or written, obtained by you from CFAITH Communities or through or
from the Service shall create any warranty not expressly stated in this
agreement and neither you nor any third party may rely on any such advice or
information. You specifically acknowledge that CFAITH Communities shall not be
liable for content uploaded by Members or Visitors, or the defamatory,
offensive, or illegal conduct of any Member, user, or other third party, and you
bear the entire risk of damage or harm from the foregoing. Such limitation shall
also apply with respect to damages incurred by reason of other services or
products received through or advertised in connection with CFAITH Communities or
the Service or any links on CFAITH Communities, as well as by reason of any
information or advice received through or advertised in connection with CFAITH
Communities or the service or any links on CFAITH Communities. Some
jurisdictions do not permit the exclusion of implied warranties or limitation or
exclusion of liability for consequential or incidental damages, so limitations
and exclusions herein may or may not be applicable to you.
INDEMNIFICATION
You agree to indemnify, hold harmless and defend CFAITH, CFAITH Communities,
and any wholly owned subsidiaries, at your expense, any and all third-party
claims, actions, proceedings, and suits brought against CFAITH Communities or
any of its officers, directors, employees, agents or affiliates, and all related
liabilities, damages, settlements, penalties, fines, costs or expenses
(including, without limitation, reasonable attorneys' fees and other litigation
expenses) incurred by CFAITH Communities or any of its officers, directors,
employees, agents or affiliates, arising out of or relating to (i) Your breach
of any term or condition of this Agreement, (ii) Your use of the service, (iii)
Your violations of applicable laws, rules or regulations in connection with the
service. Google reserves the right, at its own expense, to assume the exclusive
defense and control of any matter subject to indemnification by You.
MISCELLANEOUS
This Agreement (including all CFAITH Communities policies, guidelines, rules,
and notices incorporated by reference herein) represents the complete and
exclusive statement of the agreement between CFAITH Communities and you
regarding the use of the Site or Service; and it supersedes any prior proposal,
oral or written agreement, and any other communications between CFAITH
Communities and you relating to the subject matter of this Agreement. Any
failure of CFAITH Communities to exercise or enforce any right or provision of
this Agreement shall not constitute a waiver of such right or provision. If any
provision of this Agreement is held invalid by a court of competent
jurisdiction, the parties nevertheless agree that the court should endeavor to
give effect to the parties' intentions as reflected in the provision, and the
remainder of the Agreement shall continue in full force and effect. No agency,
partnership, joint venture, employee-employer or franchiser-franchisee
relationship is intended or created by this Agreement. Except as otherwise
expressly provided in this Agreement, there shall be no third-party
beneficiaries to this Agreement. The section titles in this Agreement are for
convenience only and have no legal or contractual effect.
